Window Guard Compliance: 2026 Requirements Update

New window guard rules took effect January 1, 2026, expanding requirements beyond traditional double-hung windows. If your building hasn’t yet reviewed compliance under the updated regulations, now is the time to assess what’s needed. 

What Changed 

Balcony/Terrace Windows Now Covered
Windows opening onto balconies or terraces above ground level now require guards, which is a major expansion of previous requirements that only covered individual apartment windows. 

Modern Window Types Included
Updated rules cover casement, awning, sliding, and other window configurations through “limiting devices” designed for non-double-hung windows. The original rules (written decades ago) only addressed double-hung windows. 

AC Installation Clarification
Permanently installed window air conditioners in double-hung windows can substitute for window guards if: properly secured with tamper-resistant screws, no opening greater than 4½ inches, L-brackets prevent sash from opening more than 4½ inches, and owner has inspected and approved installation. 

Flexible Notice Delivery
Annual window guard notices (due January 1-15) can now be delivered electronically or posted in common areas, not just individually posted.

  • Guards required where children 10 or younger live or spend 10+ hours weekly 
  • Tenant request for guards triggers installation requirement regardless of children 
  • February 15 tenant response deadline 
  • 4½ inch maximum opening standard 
  • Fire escape and emergency exit windows exempt 

Immediate Compliance Checks 

Review balcony/terrace windows: If your building has apartments with balconies or terraces above ground level, these windows now need guards when children live in the unit. 

Verify AC installations: If tenants have permanently installed window AC units, confirm they meet the new standards (proper mounting, gap limitations, L-brackets). 

Update maintenance records: Ensure documentation reflects current installations and compliance status. 

Confirm annual notice compliance: Verify January 2026 notices were sent and tenant responses collected—if not, address immediately.
