
Local Law 88 (LL88) of 2009 is aimed at boosting energy efficiency in the city’s largest properties. If you own or manage a covered building, you must comply with LL88’s lighting system upgrades and electrical sub-metering requirements, both of which are due soon.
What Does LL88 Require?
Lighting Upgrades
All covered buildings must upgrade their lighting systems to meet the current NYC Energy Conservation Code (NYCECC) standards. This includes updates to lighting power allowances and lighting controls for better efficiency and lower carbon emissions.
Sub-Metering
Non-residential tenant spaces larger than 5,000 square feet in covered buildings must have dedicated electrical sub-meters. These sub-meters enable tenants to monitor their own energy usage, driving down consumption and improving building performance. Owners must also provide monthly energy usage statements to tenants.
Who Must Comply?
Covered Buildings:
- Buildings over 25,000 gross square feet
- Multiple buildings on the same tax lot that together exceed 100,000 gross square feet
- Multiple condo buildings governed by the same board of managers that together exceed 100,000 gross square feet
Covered Tenant Spaces:
- Any single tenant space larger than 5,000 square feet
- Any floor of a covered building larger than 5,000 square feet with multiple tenants
Exemptions Include:
- One-, two-, or three-family homes and some garden-style apartments
- Dwelling units in occupancy group R-2 or R-3
- Lighting systems already in compliance with NYCECC standards as of July 1, 2010
- Tenant spaces already metered separately
Key Filing Dates & Grace Period
- May 1, 2025: Standard due date for LL88 compliance reports
- Grace Period Until June 30, 2025: For buildings facing delays, NYC DOB has provided an additional two-month window to complete filings
- Possible Extension Until August 29, 2025: If your building falls under LL97 requirements, you may have the opportunity for an extension for LL88 as well
All reports must be filed through the BEAM platform: nyc.beam-portal.org
A $115 filing fee applies to LL88 reports (waived if also filing LL97 in 2025).
