NEW YEAR, NEW COMPLIANCE: Part 2: Periodic Elevator Inspections

It’s a mantra repeated by people on countless December 31st’s. Out city is also making significant changes as we enter 2022 that will significantly impact building compliance in the New Year and beyond.

As your compliance experts, Prise is breaking down the Top 5 compliance changes for 2022 daily. This is a breakdown of the big changes coming in 2022 and a little cheat sheet on how you can get can make sure you comply.

Without further ado let’s get started with Periodic Elevator Inspections.

PERIODIC ELEVATOR INSPECTIONS

Ah, there’s that word again – periodic. The periodic elevator inspections are a(n) new/old requirement that the DOB has instituted for 2022. Old in the sense that it’s an inspection that has always taken place annually for years, with the city contracting third-party inspectors to inspect elevator devices throughout New York City. New because, in 2022, the city is putting the onus to schedule and complete these inspections on the building owners.

WHO HAS TO FILE?

Buildings with elevator devices including escalators, dumbwaiters, lifts, conveyors, etc.

WHAT IS THE CHANGE?

In the past, the DOB contracted inspectors to inspect all city elevators on an annual basis. These inspections are where the PVT violations that haunt so many buildings come from. The city paid for these inspections by charging buildings a fee on their annual tax bills.

HOW TO COMPLY?

  • Inspections must be conducted by a licensed third-party elevator agency on behalf of the owner.
  • Inspections are due by December 31st of each calendar year.
  • Inspections cannot take place within 90 days from the date of any Category 1 test or any previous period inspection.

WHO PERFORMS THESE INSPECTIONS?

  • Periodic inspections cannot be performed by an elevator maintenance company.
  • Witnessing agencies are not required to witness the periodic inspections
  • Inspections must be completed by a NYS licensed elevator inspector (most third-party witnessing agents can complete this inspection).

DEADLINE

Periodic inspections are due by 12/31/2022. Periodic inspection reports must be filed within 14 days of the inspection.

CORRECTING DEFECTS

Defects must be corrected within 90 days of the periodic inspection.  The affirmation of correction must be submitted within 14 days of the date the corrections were made:

You’ll see a pattern emerge in all our advice. It’s simple. Plan now.

  • Review your 2021 Category Inspection dates.
  • Reach out to current Third-party witnessing agencies. They should be capable of completing these inspections for you.
  • Make sure that you still get two other bids just in case there is a difference in price. While you may love your current witnessing agent, it doesn’t hurt to see where the market is with inspection fees.
  • Establish a centralized ownership email address on DOB NOW. A central email address can be used for multiple properties.
    • This also ensures that if there is any turnover with a building manager that someone will still have access to view the reports.
  • Carefully review your building’s annual tax bill to ensure the city is has removed this charge in 2022.
